Definitions

Conditions – means these terms and conditions and the Special Conditions

Product – means a product displayed for sale on the Website

Product Description – means that part of the Website where certain terms and conditions in respect of the individual Product are provided

Special Conditions – means the terms and conditions in the Product Description

Users – means the users of the Website collectively

Personal Information – means the details provided by you on registration

Made to measure bedding / bespoke bedding - These items are made to order and manufactured on a one off basis using specific measurements submitted at ordering.

Standard size beds - These sizes are Single, Double, King & Super King with a mattress depth of 7 inches (18cms) & a bed base of 14 Inches (36cms).

Cookies – means small text files which our Website places on your computer's hard drive to store information about your shopping session and to identify your computer

UK Mainland - means England, Scotland and Wales

United Kingdom – means England, Wales, Scotland, Northern Ireland and the Channel Islands

You – means a user of this Website.

Use of the website

Access

You are provided with access to this Website in accordance with these Conditions and any orders placed by you must be placed strictly in accordance with these Conditions.

Registration

You warrant that:

The Personal Data which you are required to provide when you register as a customer is true, accurate, current and complete in all respects; and

You will notify us immediately of any changes to the Personal Data by updating these details on your online account.

You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.

Indemnity

You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this Website, or the use by any other person accessing the Website using your shopping account and/or your Personal Information.

Our rights

We reserve the right to:

modify or withdraw, temporarily or permanently, this Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or

change the Conditions from time to time, and your continued use of the Website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.

Privacy and cookies

We will treat all your Personal Data as confidential (although we reserve the right to disclose this information in the circumstances set out below). We will keep it on a secure server and we will fully comply with all applicable privacy regulations and consumer legislation.

Description of products

Each Product purchased is sold subject to its Product Description which sets out additional Specific Conditions related to that Product including, without limitation, terms and conditions concerning estimated delivery dates and times, warranties, after-sales service and guarantees.

We will take all reasonable care to ensure that all details, descriptions and prices of Products appearing on the Website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the Website as up to date as possible, the information including Product Descriptions appearing on this Website at a particular time may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a Product until your order is accepted in accordance with our Order acceptance policy.

Made to measure bedding

We make all bespoke size products in our factory based in Lancashire UK.  That's every product that isn't a standard size (single, double, king or super king) plus valances for beds with split corners, heavy fabric valances, valances with a non standard drop (14") and super king / king pillows .  We also make all our bespoke cushions, bedspreads and bespoke curtains in house, plus a range of standard bedding in plain colours and some printed designs. 

Some of our stock items are made by UK designers and while not made in the UK are of an assured high quality standard.  These products have the brand visible on the product page.  We use some of our designer duvet sets to make in-between sizes such as large single and small double duvet covers.  While we can't guarantee where these duvet sets are initially made, we do finish the manufacturing of these products in the UK. Zipped bedding is included in our made to measure range

Mattress Depth.

For fitted products such as fitted sheets and mattress protectors you will see an option for mattress depth.  For these items its an easy way for us to figure out the best fit for your sheets.  We add 4 -5" (10cm approx.) to the mattress depth for any item that fits around your mattress.  This ensures the sheet is a snug fit and has enough extra fabric for tuck under.  Any bedding made for mattresses other than 7 inch deep mattresses is classed as bespoke bedding.

For example:

If you order a fitted sheet and the mattress is 7" our Fitted Sheet will finish with an approx. 12" box to cover the mattress and tuck under, with an elastic hem to keep it in place.



Ordering, cancelling and returning products

Orders

We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website. Find out more about our Refund policy which is incorporated into these Conditions.

Contract Creation and Electronic Contracting

The technical steps required to create the contract between you and us are as follows:

You place an order through our Website by completing the checkout process and selecting the button confirming that you wish to place and pay for your order. You will be guided through this process by a series of instructions on the Website.

<p>After placing your order, you will receive an order acknowledgement by email. This acknowledges that we have received your order but does not constitute our acceptance of it.

We will then send you an order confirmation email confirming that we have accepted your order. The contract between you and us is formed when we send this order confirmation.

We reserve the right not to accept an order, including where a product is unavailable, the price or product information contains an error, we cannot obtain authorisation for payment, or we are unable to fulfil the specifications requested. If payment has already been taken for an order that we cannot accept, we will refund it in full.

Payment will normally be taken when your order is placed.

When your order is dispatched, we will send you a dispatch confirmation email. This confirms that your order has been sent and does not determine when the contract was formed.

Cancelling or Changing an Order

Many of our products are made to order. Where a product is made to your chosen measurements, mattress depth, shape or other individual specifications, it is made to the consumer&rsquo;s specifications. The statutory right to cancel a distance contract does not apply to these products, except where the product is faulty, not as described or otherwise does not conform to the contract.

Products that are not made to the consumers specifications or clearly personalised remain subject to the applicable statutory cancellation rights. Please see our Returns and Cancellations Policy for further details.

Nothing in these terms affects your statutory rights in relation to faulty, damaged, incorrectly supplied or misdescribed goods.

Bedding for UK standard size Single, Double, King, Super King orders.

Orders will be sent as one package wherever possible so as not to incur further postage costs. If items are out of stock we will let you know when they are due and have them delivered as soon as they arrive with us. 

From time to time we experience some delays in supply. While do try and contact all customers regarding delays but we would ask that if your order is not received within 2 weeks of being placed please contact us for an update.

Delivery

Free Delivery - When free delivery is available it is applicable only to orders with delivery addresses within the UK mainland only.  Wherever possible we will offer discounted rates for orders overseas, please contact us for more details at info@victorialinen.co.uk

Standard Size Bedding: ( Bedding for any UK standard size bed) Goods will be dispatched normally within 7 working days when in stock. 

Bespoke / Made to measure bedding - These linens are cut, measured and sewn on site, due to manufacture times dispatch is usually within 21 days.  You can Express Your Order at the checkout and we can have it dispatched to you within 7 working days  You only need to add this once per order and we will treat your bedding as urgent.

Delivery Arrangements

Your shopping basket on the Site displays the goods you have chosen, the Seller who shall provide them and details of postage and packing. The delivery costs for each Seller vary according to the delivery methods they offer. Any delivery times quoted are in working days.

Delivery Overseas

All products overseas outside the UK are sent via registered mail or courier.  Delivery time is dependent in the service but varies from 3 to 5 working days from dispatch.

Be unused and in their original condition (including all packaging and tags intact)

Products returned with a proof of purchase. Without a proof of purchase, we are unable to provide a refund or exchange. This does not affect your statutory consumer rights.

Standard & bespoke made products - Definition

Standard size bedding

Duvets, duvet covers, flat sheets, bed valances made for UK single, Double, King & Super King beds. Bed sheets made for mattress at 7 inch (18cm).  Valances at a drop of 14 inch (35.5cm). Standard pillows & pillow cases.

Bespoke bedding

Covers every product that isn't a standard size (single, double, king or super king) plus bespoke made items including but not exclusive to:

• valances for beds with split corners,
• heavy fabric valances,
• any valance with a non standard drop (standard being 14" / 35.5cm)
• super king / king pillows & pillow cases. 
• bespoke cushions, bedspreads
• bespoke curtains in house
• Shallow or deep sheets in all sizes (sheets made for any mattress other than standard 7 inch / 18cm depth.

Furthermore for health and hygiene reasons we are unable to offer refunds or exchanges on the following items unless they are returned unused and in their original packaging and, if the item has a hygiene or security seal, with that seal intact:

• Mattress toppers

• Mattress and bedding protectors

• Duvets and duvet covers

• Pillows and pillowcases

• Throws & Blankets

• Mattresses

• Bedsheets

Bedding for standard size beds

If you decide to cancel, you should return the goods to us at your cost within 14 days of such cancellation and we will reimburse to you (by the method used to pay for the original transaction) the amount in relation to goods to which cancellation rights apply. 

 

We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you. We will make the reimbursement no later than 14 days after the day we receive back from you any goods supplied.

If the product returned is not in fully resaleable condition or the packaging is damaged, we reserve the right to refuse a refund on the item, or deduct up to 20% of the original selling price from the refund amount. This does not affect your statutory rights. Whilst you are deciding whether to keep your purchases, you do have a statutory duty to take reasonable care of our goods. Therefore, please do not damage the items whilst you inspect them

Standard size bed linens must be returned unused, in their original packaging, in a saleable condition with the tags still attached (if applicable) along with the invoice to:

We cannot accept liability for returned goods lost or damaged during transit. You are advised to wrap the product carefully to avoid damage and to return goods by recorded delivery, registered post or by courier. Proof of postage will not be accepted as proof of delivery. The cost of returning goods will be borne by the customer. Cost of return of goods cancelled after dispatch will be borne by customer.

You can expect a refund in the same form of payment originally used for purchase within 30 days after we receive your return or 7 day cancellation notice. Shipping and Handling charges will not be refunded for

(1) undeliverable packages (including those for which the shipper cannot locate the customer, resulting in the order being returned to sender or abandoned),

(2) deliveries that are refused (including instances in which the customer is unwilling to pay any applicable taxes or duties which results in the order being returned to sender or abandoned) or

(3) orders cancelled after the goods have been shipped. All undeliverable or refused orders will be treated as a return, with the same policy applied as returned items.

(4) Items that are not faulty

In the unlikely event that you receive damaged goods, please notify us in writing (or by email) within 7 days of receipt and goods will be re-dispatched on return of faulty items). Customers must be aware that Victoria Linen cannot be held liable if goods are received in a damaged condition from the courier/postal service if the items were dispatched in a saleable condition. If items are received in a damaged condition customers are advised that they must refuse delivery or sign for the goods as 'damaged' for insurance purposes.

We want you to be completely satisfied with your purchases. Please let us know if you are not entirely satisfied with our products or our service, so that we can rectify the situation. Items are described and photographed as accurately as possible, but please note that sizes, colours and designs may vary slightly.

Returns from outside the UK:

Only on the occasion of receiving faulty goods, Victoria Linen will refund the recipient with the cost of returning the item via their local post office up to a maximum cost of GB £10.00. (A receipt must be obtained). If the recipient has paid import duty, it will be repaid on a pro rata basis. The recipient should contact us to arrange their refund. This returns policy does not affect your legal and statutory rights.

In the event of returning bedding please note that any free items must also be returned to avoid a charge.

Disclaimer of warranties and limitation of liability

Import regulations and duty

If you order goods from the web site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

Made to Measure / Bespoke Bedding

These are made to order items including any items bought that use the following terms in product or the section of the site: Custom, emperor, 2'6", long single, large single, metric single, euro single, euro double, euro king, euro super king, small double, 4ft, Round, Adjustable, Four Poster, Caesar, Super Caesar, 8ft, Made to measure curtains, boxed valance sheets, easy fit velcro valances, deep fitted sheets, split corner valances and heavy fabric valances.

Bespoke products also includes all non UK standard sizes (Single, Double, King or Super King) sized bed sheets, pillow cases, duvet covers, valances, (inc standard size valances with bespoke drop), curtains, mattress protectors, bedspreads, pillows (King and Super King) & duvets (Long Single, Large Single, Small Double, Emperor, Caesar, Super Ceasar).

These linens and duvets are made to order on a one off basis, items may be returned ONLY if found to be faulty or the wrong size to what you have ordered. Please allow up to 1-2% difference in your measurements of bed linen. Linen can stretch and recede depending on the fabric. We regret they may not be exchanged/refunded for any other reason. 

Duvets sizes are made to the case size.  This size may be slightly smaller than advertised initially due to the duvet fill.  But this will spread over time to the correct size.  If you have an exact size of duvet in mind please contact us for assistance before ordering.

Samples of all our bedding fabrics are available.  Please order these via email to info@victorialinen.co.uk If you wish to be sure of a particular shade.  Exchanges or refunds cannot be accepted for bespoke items if you are not happy with the colour.

From time to time Victoria Linen will offer discounts and offers relating to its products. Victoria Linen reserve the right to change offers at any time including ending offers early. Vouchers and offers cannot be used in conjunction with one another with one discount code or offer only applicable to one order.  Some offers are detailed below: 3 for 2: On occasion we offer 3 for the price of 2 on all our UK manufactured bedding. This does not include Duvets, Quilts, Quilted bedspreads, pillows or any of the branded designer bedding in the designer bedding section, unless otherwise stipulated. We regularly offer discount codes and offers through our mailing list. Please add your email address at any of our catalogue or product pages.% or AMOUNTS OFF: On occasion, we offer applies to all custom bedding and sub categories.  All plain standard bedding manufactured by Victoria Linen UK.  Offer excludes all items on sale, designer bedding and its sub categories on the website

By using a promotional code you will be deemed to have read and understood these terms and conditions and agree to be bound by them.

The terms and conditions on the Site shall apply to promotional codes. If and to the extent there is a conflict or inconsistency between the terms and conditions of the Site and these promotional code terms and conditions, the promotional code terms and conditions shall prevail to the extent of the conflict or inconsistency. The defined terms used in the Site terms and conditions shall also apply to these promotional code terms and conditions

Victoria Linen promotional codes can only be used on Victoria Linen and towards the purchase of items currently featured on our Site, excluding delivery charges.

Promotional codes cannot be used in conjunction with any other offer on Victoria Linen, including (but not limited to) any other Victoria Linen promotional code, in the same transaction, or for the purchase of gift vouchers. The discount associated with a promotional code is applied to your entire basket, excluding any delivery charges. Promotional codes are a combination of letters and numbers, eg, SPVS1567, and should be entered on the payment page during checkout for the discount to apply. Each promotional code will have a limited time period in which to be used and/or a maximum number of orders per code. The code will be invalid once these limits have been reached. Specific terms and conditions for each promotional code setting out any such limits can either be found in the communication you received with the code itself or on the specific promotional code terms and conditions page via the Site (eg, via an on-site banner).

Victoria Linen reserves the right to suspend, change or cancel any promotional code, at any time, in the event of circumstances arising which make it necessary to do so. Victoria Linen may update these terms from time to time and reserves the right to add additional terms and conditions for specific promotional codes as and where necessary. You should review the promotional code terms and conditions periodically for changes.

Promotional codes have no cash value, cannot be transferred and cannot be forwarded or reassigned.

Any refund you may be entitled to receive will not include the redemption value of the promotional code. You will receive no more than the amount you paid towards the final basket price.

(a)To the fullest extent permitted by applicable laws, we disclaim responsibility for any harm resulting from your use of any part of the Service.

(b) The Site and App are provided “as is” and “as available” and we expressly disclaim to the fullest extent permitted by law all express, implied and statutory warranties.

(e) Nothing in these Customer Terms shall limit or exclude our liability for fraudulent misrepresentation, for death or personal injury resulting from our negligence or the negligence of our agents or employees or for any other liability that cannot be limited or excluded by law.

Refusal of transaction

We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of so refusing or by reason of unwinding or suspending any transaction after processing has begun.

 Uploading material to the Site

Uploaded material must not: (i) be defamatory of any person; (ii) contain material which is obscene, discriminatory, offensive, hateful, threatening or inflammatory; (iii) infringe any copyright, database right or trade mark of any other person; (iv) be likely to deceive any person; (v) promote any illegal activity; (vi) be likely to harass, upset, embarrass, alarm or annoy any other person; or (vii) be used to impersonate any person, or to misrepresent your identity or affiliation with any person.

Any material a user uploads to the Site will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such material for any purpose. We also have the right to disclose a user’s identity to any third party who is claiming that any material posted or uploaded by such user constitutes a violation of their intellectual property rights, or of their right to privacy. We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by users. We have the right to remove any material or posting a user makes on the Site.

Force majeure

Where we or a Seller are prevented from or delayed in carrying out obligations under these Customer Terms due to circumstances beyond our or the Seller's reasonable control including, without limitation, acts of God, governmental actions, war or national emergency, riot, civil commotion, fire, explosion, flood, inclement weather, epidemic, lock-outs, strikes or other labour disputes (whether or not relating to the Seller's workforce), or restraints or delays affecting carriers or an inability or delay in obtaining supplies of adequate or suitable materials then either our or the Seller's (as the case may be) performance of its obligations shall be postponed for the period of time that the circumstances continue.

Intellectual property and right to use

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.

You acknowledge and agree that the material and content contained within the Website is made available for your personal non-commercial use only and that you may (if necessary to make a Purchase) download such material and content onto only one computer hard drive for such purpose. Any other use of the material and content of the Website is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.

To provide additional information, on some products you'll find a link to an introductory Which? report, in turn linking to the Which? website. Which? allows you to access and print its content only for your own personal and non-commercial use.

We're pleased to be able to present Which's impartial advice on the Website, but please note that we cannot take responsibility for their recommendations or the content of any of their reports.

Compliance with laws

The Website may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the Website and any transactions conducted on or through the Website.

Limitation of liability

While we will use reasonable endeavours to verify the accuracy of any information we place on the Website, we make no warranties, whether express or implied in relation to its accuracy. The Website is provided on an "as is" and "as available" basis without any representation or endorsement made and we make no warranties of any kind, whether express or implied, in relation to the Website, or any transaction that may be conducted on or through the Website including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade.

We make no warranty that the Website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.

To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the Products. This does not affect your statutory rights as a consumer, nor does it affect your Contract Cancellation Rights.

We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the Conditions for:

any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or

any loss of goodwill or reputation; or

any special or indirect losses

suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Conditions.

Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees.

Severance

If any part of the Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Conditions.

Waiver

No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

Survival

Each provision of the Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

Entire agreement

These Conditions govern our relationship with you. Any changes to these Conditions must be in writing and signed by both parties. In this way, we can avoid any problems surrounding what Victoria Linen and you are expected to do. You confirm that, in agreeing to accept the Conditions, you have not relied on any representation save insofar as the same has expressly been made a term of these Conditions and you agree that you shall have no remedy in respect of any representation. Your Statutory Rights are not affected by these terms and conditions. Nothing in this Clause shall limit or exclude our liability in respect of any fraudulent or negligent misrepresentation whether or not such has become a term of the Conditions.

Law

The Conditions shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.
